Talkling – Terms of Service
In one minute
- What we do: Talkling lets you practice languages by exchanging voice and text messages with partners and AI.
- Free trial: 7 days with limits (10 messages/day, 100 AI suggestions/day). After that, $5/month (USD) unless you cancel.
- Unlimited perks: Paid plans unlock unlimited messages, translations, and AI suggestions for normal learners, with soft safeguards (~3k messages & ~10k AI calls/day) to prevent abuse.
- Payments: Handled by Paddle (our Merchant of Record). Taxes/VAT are added where required.
- Your stuff: You own your messages and audio. We only use them to run the service and improve quality (in aggregate/de‑identified form).
- Be kind: No abuse, spam, or illegal content.
- AI is fallible: Don't rely on it for professional advice.
1) Who we are
Talkling ("we", "us") provides a language‑learning app at talkling.app.
2) Using Talkling
- You must be 13+ or the minimum age in your country if higher.
- Create one account per person and keep your login secure.
- You're responsible for activity under your account.
3) Acceptable use
Do:
- use Talkling for learning and practice,
- respect others.
Don't:
- harass, threaten, or post illegal/offensive content,
- upload others' private data without permission,
- interfere with or attack the service,
- use Talkling for spam or commercial solicitation.
We may remove content or suspend accounts that break these rules.
4) Your content & rights
- You own your content (messages, audio, uploads).
- You grant us a limited license to host, process, transmit, and (if you choose to share) display your content to provide Talkling.
- To improve quality, we may use aggregated/de‑identified usage data and excerpts to develop features, troubleshoot, and prevent abuse. We don't sell personal data.
5) AI features
- AI characters and transcription/translation use third‑party AI (e.g., OpenAI). AI can be wrong or incomplete.
- Don't use AI outputs as medical, legal, or other professional advice.
6) Free trial, plans, billing
- Free trial: 7 days with feature limits: 10 messages per day and 100 AI suggestions per day. Limits reset daily. No payment method required to start.
- After trial: To continue using Talkling, subscribe for $5 USD/month. Your plan auto-renews monthly unless you cancel.
- Paid plan perks: Unlimited conversations, translations, and AI suggestions for everyday use. To keep the service fast for everyone, we apply soft “reasonable-use” caps of roughly 3,000 messages per day and 10,000 translation/AI suggestion calls per day.
- Merchant of Record: Payments are handled by Paddle, which also calculates and remits taxes/VAT where required. Currency conversion may apply.
- Cancellation: Cancel anytime from Settings. You'll keep access until the end of the paid period.
- Failed payments: If a renewal fails, Paddle will retry. We may pause access until payment is restored.
- Price changes: If we change prices, we'll notify you in advance; changes take effect on your next period.
Reasonable-use safeguards
- These caps almost never affect genuine learners. If you hit them, just reach out—most cases reset automatically at midnight UTC.
- Automated abuse, scraping, or attempts to bypass the caps may lead to temporary throttling or suspension per our Acceptable Use rules.
- We log daily usage counts solely to enforce these safeguards, as described in our Privacy Policy.
7) Refund policy
7-Day Trial
- New users get a 7-day free trial with feature limits (10 messages/day, 100 AI suggestions/day)
- No payment method required to start
- After trial ends, you'll be prompted to subscribe to continue
After Trial: $5/Month
- Subscribe for $5 USD/month (plus taxes/VAT where applicable) to continue using Talkling
- Billing handled by Paddle (our Merchant of Record)
- Renews monthly unless you cancel
Refund Window
If you're not satisfied:
- Email support@talkling.app within 14 days of any charge
- We'll issue a full refund
- No questions asked
Cancel Anytime
- Cancel from Settings at any time
- Access continues until the end of your paid period
Failed Payments
- If a renewal fails, Paddle will retry
- We may pause access until payment is restored
- No refund for time when service was paused due to failed payment
How to Cancel
- Go to Settings in your Talkling account
- Click Cancel Subscription
- Confirm cancellation
- You'll keep access until the end of your current billing period
How to Request a Refund
Within 14 days of any charge:
- Email support@talkling.app
- Include your account email
- Subject: "Refund Request"
- We'll process within 2 business days
Payment Processing
All payments and refunds are processed by Paddle:
- Paddle handles billing, invoices, and taxes/VAT
- Refunds appear in 5-10 business days depending on your payment method
- For payment disputes, check your Paddle receipt or contact support@talkling.app
8) Third‑party services
We rely on providers like Paddle (billing), OpenAI (AI features), and Plausible Analytics (privacy-friendly website analytics and conversion tracking). Your use of Talkling remains governed by these Terms; provider terms may also apply to their parts of the service.
9) Beta service (rapid development)
Talkling is currently offered as a beta service and is under active development. By using Talkling during this phase, you acknowledge and agree that:
- (a) features may change, be added, or be removed without notice;
- (b) the service may contain bugs and other errors;
- (c) interruptions, outages, or degraded performance may occur;
- (d) data stored in the service may be lost or corrupted, so you should regularly export and back up your content.
We do not provide any service-level commitments, uptime guarantees, or support obligations during beta. We may temporarily suspend access as needed to maintain or improve the service. We may use diagnostic and usage data and your feedback to improve Talkling, as described in our Privacy Policy.
The beta service is provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law. Nothing in this section limits or excludes liability where such limitation or exclusion is prohibited by law (for example, for fraud or, in some jurisdictions, for personal injury). If you are a consumer in the EEA/UK, this section does not deprive you of any mandatory statutory rights.
10) Termination
You can delete your account at any time in Settings. We may suspend or end access if you violate these Terms or for security/legal reasons.
11) Disclaimers & liability
- See Section 9 for beta-specific disclaimers. We don't guarantee uninterrupted or error‑free service.
- To the extent allowed by law, we're not liable for indirect or consequential damages.
- Our total liability is capped at the amount you paid in the 12 months before the claim.
12) Governing law
These Terms are governed by the laws of Poland (mandatory consumer protections in your country still apply). Disputes will be handled by the courts in Poland unless your local mandatory law says otherwise.
